Urgent ..Please help...
I am writing regarding a home in the Bay Area, CA.
My sister bought it NEW from the home builders about 8 years ago.
There is a leak in the pipes (bath tub area) inside the walls and is
dripping to the first floor. This could be serious and cost a lot of
money to repair.
Can anyone pls tell me what is the warranty for for such pipe leaks ?
We tried recaulking the bath tub ...but it did not help.
Is the builder responsible for this ?
What is the law with respect to home builders and plumbing/leaks/
related warranties ? is it 10 years ?
In speaking with the HomeBuilders they brushed us off ...saying the
warranty is only a year or so.
Do we stand on legally strong grounds ?

Most "new" home warranties are for one year, thought I've heard some states
require a two year warranty. There are options to purchase extended
warranties, which evidently your sister didn't purchase.
Let's face it, this home is no longer "new". When being a home owner, you
have upkeep and maintenance which comes out of your pocket.
And, I believe I just got sucked into a troll post.

She should call a plumber and have the leak fixed. This post is so typical
of the attitude that so many people have today, ergo the irresponsible
people in New Orleans, who refused to leave, then DEMANDED that someone help
them ( I always thought you asked for help and were grateful when it
arrives..). She needs to take responsibility of her house. It is eight
years old for christs sake! Name one product that after using for eight
years, you could take back to the manufacturer and demand that it be
repaired or replaced (okay, craftsman tools would be about the only thing I
could think of). I can imagine what Ford would do if I drove an eight year
old truck to the service department of my local dealer and expected that a
leaky radiator be fixed for no charge.
I had a house with concrete countertops that I built seven years ago. The
property values skyrocketed in the area since the home was built. The owner
called complaining that they weren't shiny anymore, and was going to sue me
if I didn't re-finish them. This jerk had over $150k equity from my direct
actions in a home that I built in a subdivision that I developed! I gave
him my Lawyers number.
My point is everybody wants something for nothing, and think that they are
entitled to that something.
Leaks Happen. Cracks happen. Tile cracks. Paint peels. This all will
happen over a period of time on any house, no matter how well built.
She needs to fix it and get on with her life. If she can't afford the
repair, she can't afford the house.
